Rents are due on the 1st day of each month with no exceptions. If rent has not been received in our office by close of business (6:30 pm) on day five, we will issue a "3 day pay or quit notice". This notification is both hand delivered and sent by US Postal service to the tenant with signature verification required.

If the rent is not paid after the 3 days to pay or quit have expired, we will file a small claims (on day 4) against the tenant for past due rent and damages to the maximum allowable amount of $5000. A summons will be delivered to the tenant by county sheriff or marshall letting the tenant know that a small claims has been submitted. By law, the tenant will be given 20 days to respond to the small claims summons.

Once the summons has been delivered and we have received confirmation, we will process the eviction paperwork to our attorney and within 2 weeks, the tenant will be evicted from the property.

The costs involved vary but can generally be recouped after the small claims is completed and the tenant is required to pay past due rents, damages to the property, and all attorney fees, filing fees and court costs. If the tenant refuses to pay us directly, we will have their Idaho State tax refunds and/or employment wages garnished until all damages awarded in small claims have been satisfied.
